General Terms and Conditions

1.GENARAL

1.1 homebet is a company operated by Soft Cube International Ltd. d.o.o. (Podgorica, Cetinjski put bb, reg. no. 5-0674527, TIN: 02956080) on 22 October, 2013. established in accordance with E-Gambling Montenegro d.o.o. (Podgorica, Moskovska br. 65., reg. no. 5-0615951)(serial no. AA 0546, numeric no 117-01/12) and approval (no. 02/01-376/3). Soft Cube International Ltd. is licensed and regulated by the government of Montenegro.

homebet and Soft Cube International Ltd. are jointly referred to as ''homebet'' for the purpose of these General Terms and Conditions.

Soft Cube International operates under www.home-bet.com domain. For certain regions can specific domains be used for satisfaction of players.

1.2 All bets placed on www.home-bet.com are operated, held, accepted, placed and processed exclusively in Montenegro. homebet pays its all betting and other taxes in Montenegro.

1.3 homebet and the Customer are the only parties involved in each betting contract.

1.4 In order to place a bet with homebet, the customer must agree on following General Terms and Conditions.

1.5 homebet reserves all its rights to modify these General Terms and Conditions. The customer is responsible to remain informed on the currently valid provisions. homebet reccomends that customer prints out these General Terms and Conditions in order to avoid misunderstandings and disputes at a later stage.

1.6 The customer is responsible to take part of all information about the applicable laws in his place of residence for online gambling. The customer must ensure that when using the website, acts as an individual customer, acts within the laws of his own jurisdiction. homebet cannot be held responsible for any violation of local laws on the part of the customer.

1.7 Playing at homebet is restricted to individuals of legal age as it is determined in the jurisdiction in which the customer is located, being an individual who has registered as a customer and who holds a player's account on homebet. Under no circumstances may a person register and play if he or she is under 18 years of age. Any deposited funds by such a person will be returned to the individual after the account been closed by the operators of homebet and any winnings/profits will be forfeited.

1.8 The Customer understands and accepts that playing on the online community services provided on homebet are for entertainment purposes only. Use of any other purposes or intention is stricly prohibited. Customer must insure that playing on homebet is only of a personal nature.

1.9 The Customer must insure that it will not be involved in any fraudulent, improper, collusive, misleading, fixing, manupulative or other unlawful activity in relation to homebet or services provided by the Operator.

1.10 If a customer's account has been Closed, the operators of homebet will re-open the customer's account if the customer lodges a complaint and provides the operator with reasonable proof that the customer has not been involved in unlawful activities. The customer must provide such proof's to homebet latest within six (6) monts period from the date the customer's account was closed. Otherwise the customer looses the right to the funds on its account.

If you intend to open more than one account, for whatever reason, homebet has the right to close all of your accounts if no reasonable explonation been provided.

1.11 By registering on homebet the customer acknowledge and confirm full acceptance of all Terms and Conditions of use and that the customer fully understands the rights, obligations, terms and conditions set forth herein. If the customer not fully understands the terms and conditions of homebet, the customer is not allowed to register on homebet and not to participate in any gambling events.



2.SITE AND SERVICES

2.1 To use the services provided by homebet on www.home-bet.com, the customer must open an account. Only one account is allowed per customer and must register personally. homebet reservers the rights to refuse any application of a customer if homebet suspects action of non-tolerated interests mentioned in terms and conditions.

2.2 The Customer must always provide and maintain correct/valid, complete information to homebet. Customer hereby acknowledge that if any of information provided by customer to homebet is false, homebet has right to refuse registration on its platform. The customer is obligated to upon request from homebet, to provide official documents such as; for example any kind of bill document, account statement or any other official documentation which homebet find necessary in order to confirm the correctness of the information provided by the customer in connection with the registration following verification procedures.

2.3 By opening an account with us, homebet warrant that you:


1. Are at least 18 years of age and above the legal age for gambling

2. Are legally capable of entering into binding contracts.

3. Have not excluded yourself from gambling and neither we nor any other operator has excluded you from gambling.

4. Are a resident in an area that permits gambling online.



3. PAYMENTS & BETS

3.1 homebet does not accept any type of cashpayments to the customer's account. Deposits can only be made via www.home-bet.com. Available payment methods, associated fees, requirements, detailed information concerning the paymentmethods is available on www.home-bet.com.

3.2 The currency of the custormer's account is decided upon registration.

3.3 The customer may access its customer's account immediately upon processing deposit and the payment supplier's confirmation that the transaction has been affected. Customer may place bets as soon as the customer has access to the funds on its account. All deposits are made in real-time and if completed sucessfully, will be credited to the customer's account instantly. All deposits processed by the customer are irreversible.

3.4 A bet on www.home-bet.com can only be placed over the internet. homebet will not accept a bet from the customer unless there are sufficient funds in the customer's account to cover the amount of the bet. homebet reservers the rights to refuse or limit any kind of bets if neccessery.

3.5 Deposits made to a customer's account must only be used as bets in games on www.home-bet.com. A deposit must atleast ones be in a bet before a withdrawal can be initiated. After acceptence of a bet by customer, it is fully binding and cannot be cancelled. If a bet is placed used by the customer's login information, the bet will be considered to have been made by the customer him/her self.

3.6 homebet reserves the rights, at any time and without prior warning, to cease to offer an announced game and to withdraw a scheduled gaming activity. In such event all commenced but not completed games will be annulled and the bets will be repaid to the customer.

3.7 There is a minimum amount of any deposit to a customer's account. In case a transfer is accepted and shown on the customer's account and homebet later receives notice from the card issuer that the transfer of any reason been reversed, homebet will temporarily close the customer's account on suspicion of fraud or stolen credit card.

3.8 Card providers, financial institutions, banks and other ''third party payment'' methods may charge a fee for processing payment. The customer is liable to pay any/such ''third party payment'' processor fee.

3.9 For protection of the customer, homebet will monitor all bets and account transactions made on www.home-bet.com. All transactions will be checked to prevent money-laundering and all suspicious transactions will be reported to the ''homebet Money Laundering Reporting Officer'' (MLRO) who will report to the advised authorities.

3.10 The customer can at any time log in to his account and view all statements which would show all transactions, deposits, bonuses, winnings, bets and withdrawals. Should the customer notice any mistakes, he/she must notify homebet immediately so that the mistake can be rectified. Such a mistake should be reported within 90 days from when the mistake first appeared on the customer's account.



4. WITHDRAWALS

4.1 Withdrawal options and associated fee requirements are all listed in the customer's account under withdrawal option.

4.2 The Customer has always access to its deposits and winnings and may at any time request a withdrawal within three (3) bank days. In case of cumulative ammounts in ecess of the equivalent of 2,500 EUR, homebet will conduct an identification verification precess to establish the customer's identiy, age and place of residence. homebet reserves the rights to perform such verification procedures in connection with withdrawals where the amount corresponds to less than the equivalent of 2,500 EUR.

4.3 Before any withdrawals are carried out, homebet has the right to request a valid document of identification, for example copy of driver's license or any other valid document of identification. homebet reserves the rights to determine which documents of identification that are acceptable. If the customer has deposited funds with credit cards or debit cards or if the customer has requested a withdrawal to be made to a credit card or debit card, homebet has the right to request copies of both front page and back page the relevant card. For the customer’s own safety, homebet recommends that the Player only makes the first six (6) numbers and the last four (4) numbers on the credit card or debit card visible when providing the copy of the card. The CVV/CVV2 number on the credit card or debit card should not be visible on the copy.

4.4 homebet reserves the right to refuse withdrawals from the customer’s Account and to Close a customer’s account if this is not used for betting on www.home-bet.com, or if there is suspicion of abuse of the homebet services, fraud or any other criminal act.



5. BONUSES AND OFFERS

5.1 homebet will form time to time award bonuses to customer's which are accounted for each separately. homebet reserves the rights to refuse or rescind different bonuses at any time for any reason. Bonus money can not be withdrawn from the customer's account as long as option been mentioned. If the customer withdraws money from its account and there still is bonus money on the customer's account which has not been put on games, such un-played bonus money on customer's account vill be automatically forfeited and will no longer be available for the customer.

5.2 In certain forms, certain games, bonus money must be used by the customer a certain number of times before any winning results from the bonus money can be withdrawn from the customer's account, also called as a turnover requirement. It is the customer's responsibility to ensure and aware of the terms and conditions of the turnover requirement at all times.

5.3 homebet reserves the right to deny or withdraw the bonus offer at any time. No written correspondence will be provided to the customer and homebet's decisions are final.

5.4 homebet reserves the right to void in some of cases bonus and winnings if the customer or any person in the customers household har previously received a similar bonus. This applies for all betting bonuses.

5.5 If the customer uses a proxy server or similar to connect to www.home-bet.com in order to alter or hide the true identity of the customer, or alter or hide the true identity of the customer's computer equipment, homebet reserves the rights to void any bonuses and any winnings made while playing with bonus money.



6. CUSTOMER SUPPORT AND COMPLAINTS

6.1 Customer support is provided and complaints are handled by homebet through an on-line help desk using the contact form at the www.home-bet.com. All inquiries and complaints must be directed to the Customer Support in writing or in electronic format. A complaint must be submitted in a valid manner when it contains clear information regarding the customer's identity and gives all relevant details giving rise to the complaint. Complaints will be handled by homebet customer support within 2 working days for submission of complaint by the customer.

6.2 Spamming on customer support chat is prohibited. Customer's are prohibited from harassing or abusing the customer support chat. Customer's are requested to adress their concerns without the use of obscenities or threatening language.

6.3 Customer's are prohibited from discussing a complaint or the lenght of time within which same has been pending or has been processed by homebet in other social places.



7. PRIVACY OF CUSTOMER INFORMATION

7.1 homebet is committed to protect all your privacy and personal information. Personal and financial information of customer will be kept cinfidential. However, under applicable laws and gaming regulations, homebet is required to maintain a secure online list of all registered Players which may be disclosed to the applicable regulator upon request by the regulator.

7.5 The customer also consents to the processing and transfer of personal data for the purposes of detecting and preventing fraud and other criminal activities in relation to homebet.

7.6 By using www.home-bet.com, you opt-in and consent to receiving communications by SMS, e-mail and telephone. Should the customer wish to opt-out from receiving such communication, the customer may opt-out by editing the settings in My Account on the website.



8. LAWS AND PROHIBITIONS

8.1 By accessing www.home-bet.com and/or registering as a customer you agree that all matters relating to your access to and use the website and services provided by homebet shall be governed by and construed in accordance with the laws of Montenegro, without giving effect to any principles of conflicts of law. Any dispute arising out of your use of the website and/or homebet’s services shall be settled by the courts of Montenegro and you hereby agree to submit to the exclusive jurisdiction of such courts.

8.2 It is the responsibility of the customer to understand the laws in his/her jurisdiction of residence relating to all aspects of playing at homebet. Your access to www.home-bet.com is on your own initiative and you are responsible for your compliance with local laws if and to the extent local laws are applicable. homebet makes no representation that materials on the website's services are appropriate, available or allowed in your jurisdiction. homebet is unable to provide any legal advice regarding this matter and homebet accepts no responsibility whatsoever should an individual act in breach of any law or regulation in transacting with homebet in whichever manner.

8.3 Any failure or delay by homebet in the performance of its obligations of its services shall not be deemed a breach of its obligations to you if such failure or delay to the extent such failure or delay is caused by fire, flood, earthquake, elements of nature or acts of God, public utility electrical failure, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, strikes, lockouts, or labour difficulties, court order, outage, delays or disruptions of the Internet or telecommunications networks, third party non-performance or any other similar cause beyond the reasonable control of homebet. homebet does not accept any liability for the consequences arising out of any such force majeure events.

9. APPLICATION OF THE TERMS OF USE

9.1 homebet reserves the right to amend or change these Terms and Conditions at any time. Any changes to these Terms and Conditions will be notified to customer in advance and will enter into force upon acceptance by the customers. If you do not accept the amended or new Terms and Conditions you may not access, use or continue to use the website or any of the services provided by homebet. homebet advises you to periodically review the Terms and Conditions in order to be informed of any changes.
